AN ORDINANCE TO AMEND CHAPTER 33 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988), BY AMENDING SECTIONS 33-32 (a) (7) <br />AND 33-57 THEREOF PERTAINING TO SUBDIVISION SIDEWALK <br />IMPROVEMENTS AND RECORDATION OF PLATS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Sections 33-32 (a) (7) and 33-57 of the Code of <br /> the City of Portsmouth, Virginia (1988), be amended and <br /> reordained Eo read as follows: <br /> <br /> Sec. 33-32. Utility and street improvements. <br /> <br /> (a) In subdivisions, or parts of subdivisions, <br /> improvements shall be provided as follows: <br /> <br /> (7) Sidewalks, at lease five (5) feet in width, shall be <br />installed on both sides of ail arEerial and collecEor streets. <br />Sidewalks, au least five (5) feet in width, shall be lnsEalled <br />along all sEreet fronEage planned for apartments or townhouses. <br />Sidewalks, at least four (4) feet in width, shall be required <br />along both sides of all minor and cul-de-sac streeEs; however, <br />the planning commission may reduce the requirements on any <br />minor suree5 or cul-de-sacs where the commission finds that one <br />(1) or more of the following criteria have been meE: the minor <br />street or cul-de-sac will have Een {10} or less platted lots; <br />or the lots will be larger than one-half {1/2) acre in size; or <br />where natural feaEures are worthy of preservation; or other <br />similarly situated lots on the sEreeE were developed prior to a <br />sidewalk requirement. The commission muse also find that such <br />reducEion will not creaue a pedestrian safeEy hazard. <br />Sidewalks shall be installed in accordance with plans and <br />specifications of the city and muse include ramps for <br />wheelchair access at all intersections in accordance with the <br />requiremenus of the Americans with Disabilities Act and in <br />accordance with any revisions approved by the Federal Highway <br />AdministraEion. Commercial or industrial subdivisions may be <br />exempted from the requirements of this section if no <br />substantial pedestrian hazard will be created thereby. <br /> <br />Sec. 33-57. Recordation. <br /> <br /> Unless the subdivider shall record his approved final <br />subdivision plat in the office of the clerk of the circuit <br />court of the city within twelve (12) months after final <br />approval as provided in Article II, said final plat approval <br />shall be null and void. The subdivider or his agent shall <br />provide the planning direcEor with a copy of the recordation <br />receipt from the clerk of the circuit courE. <br /> <br /> <br />
