purpose of abating environmental damage to or the restoration <br />of wetlands therein in such a manner as the court may, by <br />order, direcn; except thaE where the violator is the city <br />itself, or its agenE, the court shall direcE the penalty to be <br />paid into the smase ~reasury. <br /> <br /> (d) Withou5 limiting the remedies which may be obtained in <br />chapter 13 of title 28.2 (section 28.2 1300 et seq.) of the <br />Code of Virginia or the provisions contained in this article <br />and with the consenn of any person who has violated any <br />provmszon of the aforementioned chapter or of this article, or <br />who has violated or failed, neglected or refused to obey any <br />commission or wetlands board order, rule, regulation or permit <br />condition, the wetlands board may provide, in an order issued <br />by the wetlands board against such person, for the one-time <br />payment of civil charges for each violation in specific sums, <br />not to exceed ten thousand dollars ($10~000.00) for each <br />violation. Civil charges shall be mn lieu of any appropriate <br />civil penalty which could be imposed under subsection (c) of <br />this section. Civil charges may be in addition to the cost of <br />any restoramion ordered by the wetlands board. <br /> <br />Sec. 39-56. Investigations and prosecutions. <br /> <br /> The wetlands board shall have the authority to investigate <br />all projects, whether they are proposed or ongoing, which alter <br />wetlands located within the cimy. The wetlands board shall <br />have the power Eo prosecuEe all violations of any order, rule <br />or regulation of the board or any violation of any provision of <br />chapner 13 of title 28.2 (section 28.2 1300 et seq.) of the <br />Code of Virginia or of this article. <br /> <br />Sec. 39-57. Reports may be required. <br /> <br /> With respect to permits required pursuant to chapter 13 of <br />title 28.2 (section 28.2 - 1300 eE seq.) of the Code of <br />Virginia or this aruicle, the wetlands board chairman may <br />require of the person responsible for carrying out the <br />provisions of the permit such monitormng and reports as he may <br />reasonably deem necessary. <br /> <br />Sec. 39-58. On-site inspections. <br /> <br /> With respecE Eo any reported activity non authorized by <br />chapter 13 of title 28.2 (section 28.2 1300 et seq.) of the <br />Code of Virglnma or this article, or with respec5 to the <br />violation of any permit issued pursuanE thereno, the wetlands <br />board chairman may direcn suck on-site inspections as are <br />deemed reasonably necessary to determine whether the measures <br />required by the permit are being properly performed, or whether <br />the provisions of the aforementioned chapter or article are <br />being violated. Prior to conducting such inspections, notice <br />shall be provided to the residenu owner, occupant or operator, <br />who shall be given an opportunity to accompany the site <br /> <br /> <br />
