AN ORDINANCE TO AMEND SECTION 24-255 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988), BY AMENDING SUBSECTIONS (a) ~ <br />(b) THEREOF, AND BY ADDING THERETO SUBSECTIONS (c),(d),(e), (f), <br />(g) AND (h) PERTAINING TO LOUD, DISTURBING AND UNNECESSARY <br />NOISE OR SOUND. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br />1. That Section 24-255 of the Code of the City of Portsmouth, <br />Virginia (1988), be amended and reordained by amending <br />Subsections {a) and (b) and by adding Subsections <br /> (c), (d), (e), (f), (g) and (h), to read as follows: <br /> <br />Section 24-255. Loud disturbances and unnecessary noise or <br />sound. <br /> <br />(a) Any person creating any unreasonably loud, disturbing or <br />unnecessary noise or sound in the city or noise of such kind, <br />intensity or duration as to be detrimental to the life or <br />health of any individual or disturb the public peace or welfare <br />of the city shall be guilty of a Class 4 misdemeanor~ <br /> <br />(b) The following acts, among others, are declared to be loud, <br />disturbing and unnecessary noises or sounds in violation of <br />this section, but this enumeration shall not be deemed to be <br />exclusive: <br /> <br />(1) .... <br /> <br />(14) The operating, playing or permitting the operation or <br />playing of any radio, television, phonograph, drum, musical <br />instrument, sound amplifier, sound system or any similar device <br />which produces, re-produces or amplifies sound in any place of <br />public entertainment, any nightclub, any adult entertainment <br />establishment, or any adult motion picture theater, as defined <br />in Section 40-22 of the City Code, with such volume as to <br />disturb the quiet enjoyment of a person or persons beyond the <br />real property boundary of the place where such sound or noise <br />is produced. <br /> <br />(c) Definitions. <br /> <br />[As used in this ordinance, the following words and phrases <br />shall have the meanings ascribed to them in this section.] <br /> <br /> (1) A-weighted sound level. The sound pressure level in <br />decibels as measured on a sound level meter using the <br />A-weighting network. The level so read is designated dB(A). <br /> <br /> <br />
