UP-94-11 <br /> <br /> Beginning at the northeast intersection <br /> of Deep Creek Boulevard and Benton Avenue; <br /> thence along the west right-of-way of Deep <br /> Creek Boulevard in a northerly direction 250± <br /> feet to a point; thence west 220± feet to a <br /> point; thence north 120± feet to a point; <br /> thence east 311± feet to a point; thence south <br /> 18Q± feet to a point. <br /> ( <br /> <br /> 3. That this use permit is approved subject to the <br />following conditions: <br /> <br />(a) <br /> <br />A detailed~engineering site plan shall be <br />submitted to the Engineering Department for <br />review and approval prior to the issuance of a <br />building permit. <br /> <br />(b) <br /> <br />The facility shall have annual fire and <br />building code inspections and any deficiencies <br />noted shall be corrected. <br /> <br />(c) <br /> <br />Occupancy of the facility shall be limited to <br />no more than thirty (30) residents, fifty-five <br />(55) years of age or older or disabled. <br /> <br />(d) <br /> <br />A minimum of nine (9) off-street parking <br />spaces shall be constructed on the site prior <br />to occupancy and shall be maintained in good <br />repair thereafter. <br /> <br />(e) <br /> <br />The applicant shall comply with all applicable <br />codes, ordinances and regulations of federal, <br />state and local governments and shall obtain <br />and maintain in effect all necessary licenses <br />and permits. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held on September 27, 1994. <br /> <br />Teste: <br /> <br />City.
