A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE PERMIT <br />(GHP-94-2) TO PERMIT CONSTRUCTION OF FORTY-NINE (49) DETACHED <br />SINGLE-FAMILY CONDOMINIUMS AT RIVER POINTE. <br /> <br /> WHEREAS, the applicant, River Pointe Development <br />Associates, LLC~ has made application pursuant To Section <br />40-112 of the Code of the City of Portsmouth, Virginia, 1988, <br />as amended, for the approval and granting of a group housing <br />use permit for the construction of forty-nine (49) detached <br />single-family condominiums an Hirer Pointe, on property more <br />particularly described as follows: <br /> <br />GHP-94-2 <br /> <br /> Beginning au the southwest intersection <br />of West Norfolk Road and River Pointe Parkway; <br />thence west along the southern right-of-way <br />line of West Norfolk Road 250' more or less to <br />a point; thence continuing southwesterly 450' <br />more or less ~oa point; thence southeasterly <br />140' more or less to a point; thence southerly <br />230' more or less to the wesE right-of-way <br />line of River Pointe Drive; thence east along <br />the northern right-of-way line 475' more or <br />less ~o River Pointe Parkway; thence north <br />alonc the western right-of-way line of River <br />Pointe Parkway 750' more or less to West <br />Norfolk Road, the point of origin. <br /> <br /> WHEREAS, the Planning Commission has reviewed such <br />application and site plan submitted therewith and has <br />recommended conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of <br />the group housing project pursuant to Section 40-116 grants <br />only an exemption from certain requirements for residences as <br />stated in said section and does not constitute a waiver of any <br />other requirement embodied in the Subdivision Ordinance, Zoning <br />Ordinance, Code of the City of Portsmouth, Virginia, or any <br />other applicable local, state or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware that building permits or <br />any other required permit will be issued only upon compliance <br />with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW~ THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> <br />
