UP-94-4 <br /> <br /> Beginnin9 on the east right-ofLway line of Elm <br />Avenue a distance of 150 feet south from its <br />intersection with Lincoln Street; thence east along <br />a side property line 100 feet to a point; thence <br />south 37.5 feet to a point; thence west 100 feet to <br />the east right-of-way line of Elm Avenue; thence <br />north along said right-of-way 37.5 feet to the <br />point of beginning. <br /> <br /> 3. That this use permit is approved subject to the <br />following conditions: <br /> <br />The facility must receive state licensing prior <br />tO occupancy and have annual fire and building <br />code inspections. <br /> <br />The existing six (6) foot wood privacy fence <br />must be maintained. <br /> <br />C · <br /> <br />The facility shall be limited to no more than <br />five (5) residents, fifty-five (55) years of age <br />or Older or disabled. <br /> <br />d. The use permit is not transferable. <br /> <br />Hedges along the southwestern property lines <br />must be cut back to provide a sight line for <br />ingress and egress. <br /> <br />Three (3) parking spaces must be provided in <br />accordance with Exhibit A, attached hereto and <br />made a part hereof. Parking for the facility is <br />restricted to the rear of the property. <br /> <br />The applicant shall comply with all applicable <br />codes, ordinances and regulations of federal, <br />state and local governments and shall obtain and <br />maintain all necessary licenses and permits. <br /> <br />Any repeated violations of the City's building, <br />fire or environmental codes shall constitute <br />grounds for revocation of the use permit. <br /> <br /> <br />
