3 <br /> <br />A RESOLUTION AUTHORIZING TEE CITY MANAGER TO RELEASE AND VACATE <br />A PORTION OF A UTILITY EASEMENT IN THE BLOCK BOUNDED BY MT. <br />VERNON AVEAUJE, COMMERCE STREET, FLORIDA AVENUE AND PORTLAND <br />STREET TO PORT NORFOLK ASSOCIATES. <br /> <br /> WHEREAS, the Council of uhe City of Portsmouth, Virginia, <br />closed uhe alley lying between Mt. Vernon Avenue on the easu, <br />Florida Avenue on the wesT, Commerce Street on the north and <br />Portland Street on the south by an ordinance adopted on October <br />13, 1992; and <br /> <br /> WHEREAS, by said ordinance the City of Portsmouth, <br />Virginia, reserved unto itself a perpetual easement to install, <br />operate, maintain and replace public utilities over, under and <br />across said alley; and <br /> <br /> WHEREAS, Port Norfolk Associates is about to expand its <br /> facilities located in said block, and vacation and release of <br /> the easement is necessary to said construction. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, by the Council of the City <br /> of Portsmouth, Virginia, that the City Manager be, and he is <br /> hereby authorized to execute a deed of release to Port Norfolk <br /> Associates to vacate that portion of City's perpetual easement <br /> for public utilities as shown on that certain plat entitled <br /> "Plat Showing a Portion of utilities Easement to be Conveyed to <br /> Port Norfolk Associates", dated December 30, 1993, prepared by <br /> the Department of Public Utilities of the City of Portsmouth, <br /> Virginia, on the condition that an easement of 15 feet be <br /> conveyed to the City for re-routing of utilities as the City <br /> deems most practical. <br /> <br /> Adopted at a meeting of the Council of the City of <br /> Portsmouth, Virginia, at a meeting held on January 11, 1994. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
