11 A RESOLUTION AMENDING A USE PERMIT GRANTED TO HELP AND EMERGENCY RESPONSE (HER) TO OPERATE A RESIDENTIAL CARE FACILITY FOR WOMEN AND CHILDREN AT 82 CHANNING AVENb'E. WHEREAS, Horton and Dodd, P.C., has made application on behalf of Help and Emergency Response (HER) pursuanE to Section 40-43.1 of the Code of the City of Portsmouth, Virginia, 1988, to amend a use permit granted Eo HER by the City Council on November 24, 1992, to opera5e a residential care facility for women and children at 82 Channing Avenue, Portsmouth, Virginia, and; WHEREAS, the applicant and the Planning Director have done all things required ~o be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said amended use permit, with conditions. of NOW, THEREFORE, BE IT RESOLVED by the Council of the City Portsmouth, Virginia: 1. That the use for which the use permit hereinafter described is sought: (a) Will nou adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious ~o the property or improvements in the neighborhood; (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. That Help and Emergency Response (HER) is hereby granted an amended use permit pursuann ~o Section 40-43.1 of the Code of the City of Portsmouth,
