A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE PERMIT <br />(GHP-94-1) TO PERMIT CONSTRUCTION OF FOUR (4} TOWNHOUSE b-NiTS <br />LOCATED AT 5645 PARISH LANE. <br /> <br /> WHEREAS, the applicant, Herbert G. Drier, has made <br />application pursuant to Section 40-112 of the Code of the City <br />of Portsmouth, Virginia, 1988, as amended, for the approval and <br />granting of a group housing use permit for the construction of <br />four (4) townhouse units located at 5645 Parish Lane, more <br />particularly described as follows: <br /> <br />GHP-94-1 <br /> <br /> Beginning on the east right-of-way line <br />of Parish Lane a distance of 179 feet north <br />from its intersection with the north <br />right-of-way of River Shore Road; thence east <br />165 feet uo a point; thence north 93 feet to a <br />point; thence west 165 feet to the east <br />right-of-way line of Parish Lane; thence south <br />along said right-of-way 93 feet 5o the point <br />of beginning. <br /> <br /> WHEREAS, the Planning Commission has reviewed such <br />application and site plan submitted therewith and has <br />recommended conditional approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that approval of <br />the group housing project pursuan5 uo Section 40-116 grants <br />only an exemption from cerEaln requirements for residences as <br />seated in said section and does not constitute a waiver of any <br />other requirement embodied in the Subdivision Ordinance, Zoning <br />Ordinance, Code of the City of Portsmouth, Virginia, or any <br />other applicable local, ssase or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware that building permits or <br />any other required permit will be issued only upon compliance <br />with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> 1. That coupled with the terms imposed by paragraph 2 <br />herein, the following conditions exlsu: <br /> <br />(a) The proposed projece is compatible with <br /> surrounding land uses; <br /> <br /> <br />
