08DIflAflC[ NO. <br /> <br />AN ORDINANCE TO AMEND CHAPTER 22 OF TEE CODE OF THE CITY OF <br />PORTSMOUTE, VIRGINIA (1988), BY AMENDING SECTION 22-805 THEREOF <br />PERTAINING TO REDEMPTION OF TOWED VEHICLES. <br /> <br />BE IT ORDAINED by uhe Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 22-805 of the Code of the City of <br />Portsmouth, Virginia (1988) be amended and reordained to read <br />as follows: <br /> <br />Sec. 22-805. Redemption of Vehicle. <br /> <br /> (a) No vehicle impounded under the provmsmons of this <br />article shall be released or removed from the city pound, <br />excepn upon paymenn by the owner thereof, or his duly <br />authorized representative, ~o the chief of police, who shall <br />issue a recezpt therefor of a towing charge in accordance with <br />the schedule of fees sen by the City Manager in City Code <br />Section 37-250, plus a snorage charge, if the vehicle has been <br />impounded for a period of more than twenty-four (24) hours, of <br />six dollars per day or fraction thereof, plus the cost of <br />publication of any notice required by this article, plus cost <br />of investigation as to ownership and liens required by this <br />article. 'The city manager may release any such vehicle from the <br />city pound without the payment of such charges and costs, or <br />any part thereof, whenever he deems it proper so to do. The <br />owner, or his duly authorized representative, upon delivery of <br />the vehicle to him shall sign a receipt for the same. The <br />payment of the costs herein set forth, or the release of any <br />impounded vehicle without the payment of any or all of such <br />costs, shall not operate to relieve the offender from liability <br />for any fine or penalty for the violation of any law or <br />ordinance on account of which the vehicle was impounded. <br /> <br /> (b) Ail amounts received by the chief of police for <br />charges and costs as set forth in this section shall be paid to <br />the city treasurer at such times as the city manager shall <br />prescribe. <br /> <br /> 2.
