A/~ ORDINANCE TO AMEND CHAPTER 11 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING THE TITLE TO CHAPTER <br />11, BY AMENDING SECTION 11-10 THEREOF AND BY ADDING A NEW <br />ARTICLE III THERETO, PERTAINING TO EXCAVATION WITHIN THE ABEX <br />SUPERFI/N-D SITE. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virclnia: <br /> <br /> 1. That nhe title of Chapter 11 of the Code of nhe City <br />of Portsmouth, Virginia {1988) be amended to read as follows <br /> <br />"Excavation, Erosmon and Sediment Control." <br /> <br /> 2. That Section 11-10 of the Code of the City of <br />Portsmouth, Virginia (1988) be amended by adding a new <br />subsection (b) thereto to read as follows: <br /> <br />Sec. 11-10. Permit required for land-disturblng activities. <br /> <br /> (b) Any excavation acnivities within nhe Abex Superfund <br />Site Operable Unit 1 (OU1) Area as defined in Section 11-41, <br />shall also comply with the requirements of Article III of this <br />chapter. <br /> <br /> 3. That Chapner 11 of Ehe Code of the City of <br />Portsmouth, Virginia (1988) be amended by adding a new Article <br />III thereto to read as follows: <br /> <br />Article III. Excavation Requirements for Abex Superfund <br /> Site. <br /> <br />Sec. 11-41. Definitions. <br /> <br /> For the purposes of this Article, the following terms <br />shall be defined as follows: <br /> <br />"Abex Superfund Site Operable Unit 1 (OU1) Area" shall mean the <br />area generally bounded by Fifth Street on the easn, Effingham <br />Street on the west, Lincoln Street on the south, and Race <br />Street on the north and inclusive of the area within a 35G-foot <br />radius of the corner of Seventh and Harrison Streets. <br /> <br />"Excavate" shall mean any disturbance or removal of any soils, <br />including, but not limited to, soils beneath existing permanent <br /> <br /> <br />
