an River Pointe is hereby granted to River Pointe Development <br />Associates, L.L.C., subject to the following terms and <br />conditions: <br /> <br /> (a) The group housing project shall be limited to 45 <br /> detached single-family condominiums, as per the <br /> attached site plan, identified as Exhibit A and <br /> made a part hereof. <br /> <br /> (b) A landscaping plan shall be submitted to the <br /> Planning Department for review and approval and <br /> must show the landscaping treatment, including <br /> tree placement adjacent to the exposed side <br /> elevations, for Units 1, 25, 27, 39, 40, and 45, <br /> including the location and screening of <br /> mailboxes. <br /> <br /> (c) In addition to any buyer-selected brick facade <br /> options added to other units, one-story brick <br /> facades shall be provided on Units 1, 6, 7, 16, <br /> 17, 25, 27, 39, 40, and 45 as shown on Exhibit <br /> A. Substitution of an alternate unit for any <br /> unit identified in Exhibit A must be approved in <br /> advance by the Planning Director. <br /> <br /> (d) Any development in addition to the dwelling <br /> units, such as sheds or decks, as to Units 5-17, <br /> which would be located in the Chesapeake Bay <br /> Preservation areas must be approved in advance <br /> in accordance with Chapter 9.1 of the Code of <br /> the City of Portsmouth, Virginia, or any <br /> successor thereto (Chesapeake Bay Preservation <br /> Area Overlay District Ordinance). <br /> <br /> (e) Any revisions to the site plan, landscaping plan <br /> or approved elevations made throughout the group <br /> housing permit application process, including <br /> changes made pursuant to City Council request, <br /> must be submitted to the Planning Department for <br /> review and approval prior to application for or <br /> issuance of any building permits. <br /> <br /> (f) The applicant shall comply with all applicable <br /> codes, ordinances and regulations of federal, <br /> state and local governments, and shall obtain <br /> and maintain in effect all necessary permits. <br /> <br /> 3.
