an River Pointe is hereby granted to River Pointe Development Associates, L.L.C., subject to the following terms and conditions: (a) The group housing project shall be limited to 45 detached single-family condominiums, as per the attached site plan, identified as Exhibit A and made a part hereof. (b) A landscaping plan shall be submitted to the Planning Department for review and approval and must show the landscaping treatment, including tree placement adjacent to the exposed side elevations, for Units 1, 25, 27, 39, 40, and 45, including the location and screening of mailboxes. (c) In addition to any buyer-selected brick facade options added to other units, one-story brick facades shall be provided on Units 1, 6, 7, 16, 17, 25, 27, 39, 40, and 45 as shown on Exhibit A. Substitution of an alternate unit for any unit identified in Exhibit A must be approved in advance by the Planning Director. (d) Any development in addition to the dwelling units, such as sheds or decks, as to Units 5-17, which would be located in the Chesapeake Bay Preservation areas must be approved in advance in accordance with Chapter 9.1 of the Code of the City of Portsmouth, Virginia, or any successor thereto (Chesapeake Bay Preservation Area Overlay District Ordinance). (e) Any revisions to the site plan, landscaping plan or approved elevations made throughout the group housing permit application process, including changes made pursuant to City Council request, must be submitted to the Planning Department for review and approval prior to application for or issuance of any building permits. (f) The applicant shall comply with all applicable codes, ordinances and regulations of federal, state and local governments, and shall obtain and maintain in effect all necessary permits. 3.
