R-96-20 A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY OWNED BY BRINKLEY TRAILER COURT, INC., UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT TO THE CHARTER OF THE CITY OF PORTSMOUTH, VIRGINIA, FOR THE WIDENING OF GEORGE WASHINGTON HIGHWAY. WHEREAS, the Council of the City of Portsmouth has determined it to be in the public interest to widen George Washington Highway in the area of the entrance into new Navy housing erected to the south of said Highway; and WHEREAS, the City has not been able to purchase the property described herein, necessary to the project, because the owner thereof and uhe City have not been able to agree upon the price to be paid therefor; and WHEREAS, the advancement of the work and the use of the property will be unreasonably delayed if said property is not made available for the project as soon as possible. NOW, THEREFORE BE IT RESOLVED By the Council of the City of Portsmouth, Virginia: That the City Attorney be, and he hereby is, directed to institute eminent domain proceedings against the hereinafter-described property situate in the City of Portsmouth, Virginia, for the purpose of acquiring the fee simple title thereto pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth, Virginia, as amended, and to deposit with the clerk of the Circuit Court of the City of Portsmouth as provided by law, the sum of $500.00 to be paid pursuant to order of the Court specified to compensate the owner of the property described as follows, to-wit: Ail that certain piece or parcel of land, lying and being in the City of Portsmouth, Virginia, being denoted as Brinkley Acquisition Area = 120.0 S.F. (0.0028 AC.) of that parcel shown or designated as "Now or Formerly Brinkley Trailer Court Tax Map 385, Parcel 2 (D. B. 955, Pg. 380)" on that certain plat entitled "Plat Showing Property To Be Acquired By The City Of Portsmouth, Virginia For Right Of Way Purposes, Portsmouth, Virginia", made by C. Allan Bamforth, Jr., Engineer-Surveyor, Ltd. The name of the property owner is Brinkley Trailer Court, Inc.
