R-1996-14 A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE PERMIT (GHP-96-01) TO PERMIT CONSTRUCTION OF FOUR TOWNHOUSE RESIDENTIAL UNITS AT 5645 PARISH LANE. WHEREAS, the applicant, Herbert G. Drier, owner of the subject property, has made application pursuant to Section 40-112 of the Code of the City of Portsmouth, Virginia (1988), as amended, for the approval and granting of a group housing permit for the construction of four townhouse residential units at 5645 Parish Lane, Portsmouth, Virginia, more particularly described as follows: GHP-96-1 Beginning on the east right-of-way line of Parish Lane a distance of 179 feet north from its intersection with the north right-of-way of River Shore Road; thence east 165 feet to a point; thence north 93 feet to a point; thence west 165 feet to the east right-of-way line of Parish Lane; thence south along said right-of-way 93 feet to the point of beginning. WHEREAS, the Planning Commission has reviewed such application and site plan submitted therewith and has recommended conditional approval of said application; and WHEREAS, the applicant has been informed that approval of the group housing project pursuant to Section 40-116 grants only an exemption from certain requirements for residences as stated in said section and does not constitute a waiver of any other requirement embodied in the Subdivision Ordinance, Zoning Ordinance, Code of the City of Portsmouth, Virginia, or any other applicable local, state or federal law or regulation; and WHEREAS, the applicant is aware that building permits or any other required permit will be issued only upon compliance with the ordinances, laws or regulations applicable thereto. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: !. That coupled with the terms imposed by paragraph 2 herein, the following conditions exist:
