a youth center/ child day care center on property located in <br />the City of Portsmouth, said property being more particularly <br />described as: <br /> <br /> UP-94-13(M) <br /> <br /> Beginning at a point 650.70 feet <br /> east of the intersection of Portsmouth <br /> Boulevard and Hodges Manor Road along the <br /> southern right-of-way of Portsmouth <br /> Boulevard; thence 307.31feet S 77' 38' 00" E <br /> to a point; thence 354.19 feet S 7' 53' 16" E <br /> to a point; thence 351.93 feet <br /> N 77' 39' 00" W to a point; thence 171.47 <br /> feet N 6' 21' 00" E to a point; thence 65.18 <br /> feet N 45' 08' 00 W to a point; thence 126.85 <br /> feet N 10' 05' 00" E to the point of <br /> beginning. <br /> <br /> 3. That the use permit is approved subject to the <br />following conditions: <br /> <br /> (a) In lieu of the wooden stockade fence required by <br /> Condition 3 (f) of UP-94-13, the applicant shall <br /> construct landscaping berms, three feet in <br /> height, around the sides and rear of the property <br /> in accordance with Exhibit A, attached hereto and <br /> made a part hereof. <br /> <br /> (b) All other conditions previously established for <br /> the operation of the facility under Use Permit <br /> UP-94-13, approved by resolution of the Council <br /> of the City of Portsmouth, Virginia, on October <br /> 25, 1994, shall remain in full force and effect. <br /> <br /> 4.
