UP-96-10 <br /> <br /> Beginning at a point approximately <br /> 1,196 feet from the northeastern <br /> intersection of Victory Boulevard and <br /> Deep Creek Boulevard and northeast <br /> approximately 635 feet along the property <br /> line of (western) Rack and Sack shopping <br /> Center / Victory Village Apartment thence <br /> northwest 40± feet to a point; thence <br /> northeast 46± feet to a point; thence <br /> southeast 44 +/- feet to a point; thence <br /> southeast 23± feet to a point; thence <br /> southwest 21± feet to a point; thence <br /> southwest 15 +/- feet to the point of <br /> beginning. <br /> <br /> 3. That this use permit is approved subject to the <br />following conditions: <br /> <br /> (a) The facility shaI1 be located and developed in <br /> accordance with the site plan and elevation shown <br /> on Exhibits A and B, attached hereto and made a <br /> part hereof. <br /> <br /> (b) The applicant shall plant and maintain <br /> landscaping around the facility in accordance <br /> with Exhibit A. <br /> <br /> (c) Approval of the submitted plans is valid only for <br /> the location shown in Exhibit A. <br /> <br /> (d) Access to the facility shall only be from the <br /> adjacent shopping center to the east, and the <br /> applicant shall furnish to the Planning Director <br /> satisfactory proof of its right of access prior <br /> to construction of the facility. <br /> <br /> 4.
