breakfast inn to be located at 314 Court Street, being more <br />particularly described as: <br /> <br /> UP-96-06 <br /> <br /> Beginning at a point approximately 870 <br /> feet from the northwestern intersection of <br /> Court Street and North Street thence north <br /> 30 feet along the western right-of-way line <br /> of Court Street to a point; thence west 113 <br /> feet to a point; thence south 30 feet to a <br /> point; thence east 113 feet to the point of <br /> beginning. <br /> <br /> 3. That this use permit is approved subject to <br />following conditions: <br /> <br /> (a) Unless otherwise provided herein, the inn shall <br /> be operated in accordance with a letter dated <br /> April 23, 1996, from Sheila A. Gregory to the <br /> Planning Commission, identified as Exhibit A and <br /> made a part hereof. <br /> <br /> (b) No more than five bedrooms shall be used for the <br /> inn. <br /> <br /> (c) The applicants shall keep a guest register of all <br /> guests and shall make the register available for <br /> inspection to the City of Portsmouth at any time. <br /> <br /> (d) Only overnight guests may be served meals or <br /> refreshments. CommercIal meal service may not be <br /> offered to non-overnight inn guests. <br /> <br /> (e) No additions or alterations to the exterior of <br /> the structure shall be made unless approved by <br /> the Commission of Architectural Review. <br /> <br /> (f) Prior to issuance of the occupancy permit, the <br /> applicants shall provide seven off-street parking <br /> spaces within 300 feet of the inn, either through <br /> agreement with the Traffic Engineer or by other <br /> means in accordance with the City Code. <br /> <br /> (g) The applicants shall operate the inn in <br /> accordance with Section 40-52.7 of the Zoning <br /> Ordinance and all applicable codes, ordinances <br /> and regulations of federal, state and local <br /> governments, and shall obtain and maintain in <br /> effect all necessary licenses and permits. <br /> <br /> <br /> <br />
