AN ORDINANCE TO AMEND CHAPTER4 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS 4-74, 4-98(a) <br />AND (b), 4-99, 4-100 AND 4-102, AND BY REPEALING SECTION <br />4-98(e) THEREOF, PERTAINING TO ANIMALS AND FOWL. <br /> <br /> BE IT ORDAINED by the Council of the City of PortsmoUth, <br />Virginia: <br /> <br /> 1. That Sections 4-74, 4-98(a) and (b), 4-99, 4-100 and <br />4-102 of the Code of the City of Portsmouth, Virginia (1988) be <br />amended and reordained to read as follows: <br /> <br />Sec. 4-74. <br /> <br />Records, reports and audit of license sales; <br />destruction of unsold tags, and disposition of <br />funds. <br /> <br /> (a) The city treasurer shai1 e~te~ i~a dog license sales <br />record the date of the sale of dog!tags, including kennels, the <br />names and addresses of persons to Whom sold and the serial <br />number of the tags and shall keep an account 6f the amount of <br />the license tax paid. The city treasurer shall keep a copy of <br />such dog license sales record in numerical order and at the <br />close of the calendar year shall file an annual report of such <br />sales with the city manager and the city controller. The city <br />controller shall audit such records, accounts and unsold dog <br />license tags and authorize the city treasurer to destroy unsold <br />tags. <br /> <br /> (b) The city treasurer shall deposit all funds collected <br />for dog license taxes into the General Fund of the City. The <br />City shall use the funds for the foll0wihg purposes: <br /> <br /> 1. The salary and expen~es.~of the animal warden and <br />necessary staff; <br /> 2. The care and maintenance of a dog pound; <br /> 3. The maintenance of a rabies control program; <br /> 4. Payments as a bounty to any person neutering or <br />spaying a dog up to the amount of one year of the license tax <br />as provided by ordinance; <br /> 5. Payments for compensation as provided in Section <br />3.1-796.118 of the Code of Virginia; and <br /> 6. Efforts to promote sterilization of dogs and cats; <br /> <br /> Any funds unexpended for such purposes on December 31st of <br />any year, will remain in the General Fund of the City. <br /> <br />Sec. 4-98.
