A}~ ORDINAi~CE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988), BY AMENDING SECTION 40-56 AND TABLE 40-43.1-3 THEREOF, PERTAINING TO THE CREATION OF A DOWNTOWN TRADE, CULTURAL AND ARTS (TCA) SUBDISTRICT. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Section 40-56 of the Code of the City of Portsmouth, Virginia (1988), be amended by adding thereto a new subsection (h), to read as follows: Sec. 40-56. DOWntown districts; permitted uses. Uses permitted in the Downtown D-1 and D-2 districts shall be governed according to subdistricts, as'shoWn on the zoning map. Table 40-43 in Article IV of this chapter lists the uses allowed in the various subdistricts. The designation and general purposes of the subdistricts are as follows: (a) (g) .... (h) Trade, Cultural and Arts (TCA) Subdistrict. Primarily cultural, arts, educational, entertainment, restaurants, specialty retail and service businesses. 2. That Table 40-43.1-3 of the Code of the City of Portsmouth, Virginia (1988), be amended and reordained to add a Trade, Cultural and Arts (TCA) subdistrict to the Downtown D-1 and D-2 districts, having the following uses as permitted uses therein, as shown on Exhibit A, attached hereto and made a part hereof: Fruit and Vegetable (vendors, as defined in Section 32-172) (S.I.C. 5431) Direct selling (vendors, as defined in Section 32-172) (S.I.C. 5963) 3. That Table 40-43.1-3 of the Code of the City of Portsmouth, Virginia (1988), be amended and reordained to allow the following uses upon issuance of a group housing use permit in the Trade, Cultural and Arts subdistrict of the Downtown D-1 and D-2 districts, as shown on Exhibit A, attached hereto: DWelling, attached row Dwelling, multi-family Housing for the elderly
