ORDINANCE <br /> <br />AN ORDINANCE TO AMEND SECTIONS 23-46, 23-48(a), 23-49 AND 23-50 <br />OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988), AS <br />AMENDED, PERTAINING TO INOPERATIVE VEHICLES. <br /> <br /> BE IT ORDAINED by the COuncil of the City of PortsmoUth, <br />Virginia: <br /> <br /> 1. That Section 23-46 of the Code of the City of <br />Portsmouth, Virginia (1988), be amended and reordained to read <br />as follows: <br /> <br />Section 23-46. Prohibition against open storage on certain <br /> property. <br /> <br /> (a) It shall be unlawful for any person to keep, except <br />within a fully enclosed building or structure or otherwise <br />shielded or screened from view, on any property zoned for <br />residential or commercial or agricultural purposes, any motor <br />vehicle, trailer or semi-trailer, (1) which is not in operating <br />condition; or (2) which has been partially or totally <br />disassembled by the removal of tires and wheels, the engine or <br />other essential parts required for operation of the vehicle; or <br />(3) which lacks either a current license plate, a current city <br />decal, or a current state inspection decal. <br /> <br /> (b) Vehicles defined in paragraph (a) of this section may <br />be otherwise shielded or screened from view by the use of a <br />cover which completely conceals the inoperative vehicle from <br />view. The use of tarps, covers, pieces of cloth, canvas or <br />other methods of covering the motor vehicle which do not <br />completely shield or screen the vehicle from view at all times, <br />are forbidden. No more than one (1) inoperative motor vehicle, <br />which is shielded or screened from view by a cover, shall be <br />allowed to remain on any property outside of a fully enclosed <br />building or structure. <br /> <br /> (c) ~he provisions of this section shall not apply to a <br />licensed business which, on July 22, 1975, was regularly <br />engaged in business as an automobile dealer, salvage dealer or <br />scrap processor. <br /> <br /> 2. That Section 23-48(a) of the Code of the City of <br />Portsmouth, Virginia (1988), be amended and reordained to read <br />as follows: <br /> <br />Sec. 23-48v Notice to remove. <br /> <br /> (a) If the director finds any inoperative motor vehicle, <br />trailer or semi-trailer kept or stored in violation of Section <br /> <br /> <br />
