41 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE SUCH DEEDS <br />AS MAY BE NECESSARY TO ACQUIRE A PORTION OF A 40 FOOT STRIP ON <br />THE NORTH SIDE OF CHURCHLAND BOULEVARD AND THEN TO CONVEY SAID <br />PROPERTY TO THE COMMONWEALTH OF VIRGINIA, FOR THE WIDENING OF <br />CHURCHLAND BOULEVARD. <br /> <br /> WHEREAS, by deed dated August 28, 1987, and duly recorded <br />in the Clerk's Office of the Circuit Court of the City of <br />Portsmouth in Deed Book 994, at page 258, the City of <br />Portsmouth did convey to Churchland Shopping Center Associates, <br />a Virginia General Partnership, a forty (40) foot strip of land <br />dedicated for future road widening on the plat of Pride Homes <br />for the sum of twenty-five thousand dollars ($25,000.00); and <br /> <br /> WHEREAS, said deed provided that in the event all, or a <br />portion of said strip was necessary for street improvements to <br />Churchland Boulevard as a part of Department of Transportation <br />Project U00-124-105, PE101, Churchland Shopping Center <br />Associates would reconvey said property, or a portion thereof, <br />to the City for the sum of twenty-five thousand dollars <br />($25,000), or a portion or part thereof should less than the <br />whole of the entire parcel be necessary; and <br /> <br /> WHEREAS, the Virginia Deparsment of Transportation has <br />embarked upon a program of acquisition preparatory to the <br />widening of Churchland Boulevard, and has called upon the City <br />to reacquire a portion of the strip hereinabove mentioned, and <br />convey the same to the Commonwealth of Virginia. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the City Manager be, and he <br />hereby is authorized to acquire so much of that certain forty <br />(40) foot strip of land conveyed to Churchland Shopping Center <br />Associates by deed dated August 28, 1987, and duly recorded in <br />the Clerk's Office of the Circuit Court of the City of <br />Portsmouth in Deed Book 994, at page 258, and to then convey to <br />the Commonwealth of Virginia the land reacquired by such deed. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held on April 25, 1995. <br /> <br /> Teste: <br /> <br /> <br /> City Clerk <br /> <br /> <br />
