33 <br /> <br />A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY <br />OWNED BY DEBORAH L. DILLOW UNDER EMINENT DOMAIN PROCEEDINGS <br />PURSUANT TO THE CHARTER OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />SAID PROPERTY BEING NECESSARY FOR THE WIDENING IN THE TWIN <br />PINES ROAD PROJECT. <br /> <br /> WHEREAS, the Council of the City of Portsmouth has <br />determined it to be in the public interest to widen Twin Pines <br />Road; and <br /> <br /> WHEREAS, the City has not been able to purchase the <br />property described herein, necessary to the project, because <br />the owner thereof and the City have not been able to agree upon <br />the price to be paid therefor; and <br /> <br /> WHEREAS, the advancement of the work and the use of said <br />property will be unreasonably delayed if said property is not <br />made available for the project as soon as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, that the City Attorney be, and he <br />hereby is, directed to institute eminent domain proceedings, <br />including the filing of certificates of taking against the <br />hereinafter-described property situate in the City of <br />Portsmouth, Virginia, for the purpose of acquiring the fee <br />simple title thereto pursuant to Sections 2.06, 2.07 and 2.08 <br />of the Charter of the City of Portsmouth, Virginia, as amended. <br /> <br /> BE IT FURTHER RESOLVED that the City Attorney be, and he <br />hereby is, directed to deposit the sum of $338.30 to the credit <br />of the Clerk of the Circuit Court of the City of Portsmouth as <br />provided by law to compensate Deborah L. Dillow, the owner of <br />the property, designated and shown on "Plat Showing Property To <br />Be Acquired by the City of Portsmouth for Right-Of-Way <br />Purposes, Portsmouth, Virginia," prepared by Horton & Dodd, <br />P.C., Surveyors, Engineers and Planners, dated August 22, 1994, <br />a copy of which plat is attached hereto and made a part hereof. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held on April 11, 1995. <br /> <br /> Teste: <br /> <br /> <br /> City Clerk <br /> <br /> <br />
