UP-95-06 <br /> <br /> Beginning on the south right-of-way of Trucker <br /> Street 125'± east from its intersection with the <br /> east right-of-way Tyre Neck Road; thence south <br /> 142'± to a point; thence east 180'± to a point; <br /> thence north 142'± to a point; thence west 180'± <br /> to the point of beginning. <br /> <br /> 3. That this use permit is approved subject to the <br />following conditions: <br /> <br /> (a) Occupancy of the facility shall be limited to <br /> twenty-three (23) residents, aged fifty-five (55) <br /> or older or mentally challenged and to required <br /> staff members. <br /> <br /> (b) Prior to occupancy and at least annually <br /> thereafter, the facility shall request an <br /> inspection by the Fire Prevention Bureau, the <br /> Public Health Department and the Building <br /> Official and shall correct any noted <br /> deficiencies. <br /> <br /> (c) The project shall be developed in accordance with <br /> submitted site and floor plans as approved by the <br /> City. <br /> <br /> (d) The use permit shall not be transferable. <br /> <br /> (e) The facility shall comply with all applicable <br /> codes, ordinances and regulations of federal, <br /> state and local governments, and shall obtain and <br /> maintain in effect all necessary licenses and <br /> permits. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at meeting held on March 28, 1995. <br /> <br /> Teste: <br /> <br /> <br /> City Clerk <br /> <br /> <br />
