2. That Churchland House, L.P., is hereby granted a use <br />permit pursuant to Section 40-43.1 of the Code of the City of <br />Portsmouth, Virginia (1988) for the operation of an adult <br />residential care facility on property located at 3911 Cedar <br />Lane, and being more particularly described as: <br /> <br /> UP-95-19 <br /> <br /> Beginning at the southeast corner of <br /> the intersection of Cedar Lane and the <br /> Norfolk, Franklin and Danville Railway <br /> right-of-way; thence, south 125'± to a <br /> point; thence, east 237'± to a point; <br /> thence, north 136'± to a point; thence, <br /> west 180'± to a point; thence, in a <br /> southwesterly direction 49'± to the point <br /> of the beginning. <br /> <br /> 3. That this use permit is approved subject to the <br />following conditions: <br /> <br /> (a) Occupancy of the facility shall be limited to <br /> seventy-two (72) residents, aged fifty-five (55) <br /> or older, and to required staff members. <br /> <br /> (b) Prior to occupancy and at least annually <br /> thereafter, the facility shall request an <br /> inspection by the Fire Prevention Bureau, the <br /> Public Health Department and the Building <br /> Official and shall correct all noted <br /> deficiencies. <br /> <br /> (c) The project shall be developed in accordance with <br /> submitted site and floor plans as approved by the <br /> City. <br /> <br /> (d) The use permit shall not be transferable. <br /> <br /> (e) The facility shall comply with all applicable <br /> codes, ordinances and regulations of federal, <br /> state and local governments, and shall obtain and <br /> maintain in effect all necessary licenses and <br /> permits. <br /> <br /> (f) The applicant shall save as many of the existing <br /> trees on the site as is practicable. <br /> <br /> (g) The applicant shall develop a Group 1 landscaping <br /> buffer between the site and the adjacent railroad <br /> right-of-way. <br /> <br /> <br /> <br /> <br />
