71 <br /> <br />A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY <br />OWNED BY GEORGE HARVEY BURROUGHS, ROBERT C. BURROUGHS, MILO D. <br />BURROUGHS AND/OR THEIR HEIRS, DEVISEES OR SUCCESSORS IN TITLE, <br />AND UNKNOWN PARTIES UNDER EMINENT DOMAIN PROCEEDINGS PURSUANT <br />TO THE CHARTER OF THE CITY OF PORTSMOUTH, VIRGINIA. <br /> <br /> WHEREAS, the Council of the City of Portsmouth has <br />determined that there is an abandoned and unused cemetery of 12 <br />feet square located in that block of the City bounded by <br />PortCentre Parkway, Madison, Fifth and Edwards Streets, which <br />said land is necessary for the public purpose of redevelopment <br />of that area formerly known as "Newtown", and now referred to <br />as "Southside"; and <br /> <br /> WHEREAS, efforts to reach an agreement as to purchase <br />price, and/or purchase of the property have proved unsuccessful <br />in that the City has been unable to make contact with any <br />person believed to be an owner of said property; and <br /> <br /> WHEREAS, the use of said property for the redevelopment <br />and general welfare of the City will be unreasonably delayed if <br />said property is not made available as soon as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> That the City Attorney be, and he hereby is, directed to <br />institute eminent domain proceedings against the <br />hereinafter-described property situate in the City of <br />Portsmouth, Virginia, for the purpose to acquiring the fee <br />simple title thereto pursuant to Section 2.06, 2.07 and 2.08 to <br />the Charter of the City of Portsmouth, Virginia, as amended, <br />and to deposit with the Clerk of the Circuit Court of the City <br />of Portsmouth as provided by law, the sum of $100.00 to be paid <br />pursuant to order of the Court specified to compensate the <br />owner or owners of the property described as follows, to-wit: <br /> <br /> All that certain piece or parcel of <br /> land, lying, and being in the City of <br /> Portsmouth, Virginia and being 12 feet <br /> square, on which a tree and the grave of <br /> J. C. P. Edwards is located, which said <br /> square of land is located in the rear <br /> portion of a lot conveyed by Florence R. <br /> Belote and husband to George T. Taylor, <br /> with the right of ingress and egress to <br /> and from said grave as reserved, said <br /> parcel of land surrounding said square <br /> being <br /> <br /> <br />
