68 A RESOLUTION AUTHORIZING THE VIRGINIA DEPARTMENT OF TRANSPORTATION TO ESTABLISH A PROJECT FOR THE REALIGNMENT OF FREDERICK AND AIRLINE BOULEVARDS. WHEREAS, the City Council of Portsmouth, Virginia, desires that the Virginia Department of Transportation (VDOT) establish a project for (a) the realignment of Frederick Boulevard as a four-lane divided highway approximately .6 miles In length, between Scott Street and High Street; and (b) the realignment of Airline Boulevard to intersect with Frederick Boulevard at Bart Street; and WHEREAS, pursuant to VDOT construction allocation procedures, a resolution must be adopted by the governing body requesting that VDOT program an urban highway project and agreeing to reimburse VDOT for its total costs should the city elect to cancel the project. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Portsmouth, Virginia, hereby requests that the above-described project for the realignment of Frederick and Airline Boulevards be programmed by the Virginia Department of Transportation as an urban highway project. BE IT FURTHER RESOLVED, that the City Council of Portsmouth hereby agrees to pay its share of the total cost for preliminary engineering, right of way acquisition and construction of this project in accordance with Section 33.1-44 of the Code of Virginia; and that, if the City of Portsmouth subsequently elects to cancel this project, the City of Portsmouth hereby agrees to reimburse the Virginia Department of Transportation for the total amount of the costs expended by the Department through the date the Department is notified of such cancellation, if such reimbursement is not waived by the Commonwealth Transportation Board.
