A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE PERMIT <br />(GHP-95-01) TO PERMIT CONSTRUCTION OF 112 APARTMENT UNITS AT <br />THE FORMER WILLIAMS COURT SITE ON VICTORY BOULEVARD. <br /> <br /> WHEREAS, the applicant, Beacon Construction Company, <br />contract purchaser of the subject property, has made <br />application pursuant to Section 40-112 of the Code of the City <br />of Portsmouth, Virginia, i988, as amended, for the approval and <br />granting of a group housing use permit for the construction of <br />112 apartment units at the former Williams Court site on <br />Victory Boulevard (Tax Plate 455, Parcel 1), more particularly <br />described as follows: <br /> <br /> GHP-95-01 <br /> <br /> BEGINNING at a point approximately 379 <br /> feet from the northeastern intersection of <br /> Victory Boulevard and Deep Creek Boulevard <br /> thence southeast approximately 615 feet along <br /> the northern right-of-way line of Victory <br /> Boulevard to a point; thence north 212 <br /> feet to a point; thence east 200± feet to a <br /> point; thence northeast 440± feet to a point; <br /> thence northwest 735± feet to a point; thence <br /> southwest 250± feet to a point; thence <br /> southeast 410± feet to the point of <br /> beginning. <br /> <br /> WHEREAS, the Planning Commission has reviewed such <br />application and site plan submitted therewith and has <br />recommended conditional approval of said application; and <br /> <br /> WHEREAS, the applicant has been informed that approval of <br />the group housing project pursuant to Section 40-116 grants <br />only an exemption from certain requirements for residences as <br />stated in said section and does not constitute a waiver of any <br />other requirement embodied in the Subdivision Ordinance, Zoning <br />Ordinance, Code of the City of Portsmouth, Virginia, or any <br />other applicable local, state or federal law or regulation; and <br /> <br /> WHEREAS, the applicant is aware that building permits or <br />any other required permit will be issued only upon compliance <br />with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> 1.
