ZONING AMENDMENT ORDINANCE Z-97-07 BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That the portion of the zoning map attached to and made a part of the City of Portsmouth Zoning Ordinance which now zones as Residential RS-75 and Commercial C-1, the property described in Petition for Zoning Amendment Number Z-97-07, is hereby amended and changed so as to show said property zoned as Commercial C-2-K (Conditional), and that said property is hereby zoned as Commercial C-2-K (Conditional). 2. That the property affected by this ordinance by being zoned Commercial C-2-K (Conditional), is described as follows: Z-97-07 Beginning at the eastern corner of the intersection of Hartford Street and Pacific Avenue; thence, south 150'± to a point; thence, east 100'± to a point; thence, north 150'± to a point; thence, west 100'± to the point of the beginning. 3. That Zoning Amendment Ordinance Z-97-07 is conditioned upon the following as proffered by the owners, Michael and Theresa Anderson: (a) The use of the .property shall be limited to auto repair. (b) Access to the property shall be limited to the existing entrances on Hartford Street and Cambridge Avenue. (c) The site shall be screened from the adjacent residential property with 6 foot wooden fencing. (d) Privacy fencing such as board on board fencing (not stockade fencing) shall also be installed along the Pacific Avenue and Hartford Street frontage up to the Hartford Street access, within thirty (30) days of adoption of a rezoning resolution. The fencing shall be set back thirty (30) feet from Hartford Street, in accordance with corner visibility requirements of Section 40-44.1(c) of the Portsmouth City Code. The fencing shall be set back five (5) feet from the Pacific Avenue property line.
