AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF <br />PDRTSMOUTH, VIRGINIA (I988) BY AMENDING SECTION 40-43.4 (8) <br />THEREOF PERTAINING TO HOME OCCUPATIONS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia: <br /> <br /> 1. That Section 40-43.4 (8) of the Code of the City of <br />Portsmouth, Virginia (1988) be amended and reordained to read <br />as follows: <br /> <br />Sec. 40-43.4. Conditions for specific uses. <br /> <br />(8) Limited to offices operated as an incidental <br /> home occupation. Not more than 25 percent of the <br /> total floor area in the dwelling shall be devoted <br /> to such occupancy. The use must be clearly <br /> incidental and secondary to the use of the dwelling <br /> purposes and must not change the character thereof. <br /> The use shall be conducted entirely within the <br /> principal dwelling. The use shall be conducted <br /> entirely by the occupants thereof, and no person <br /> who is not a resident of the dwelling shall be <br /> employed in connection with the home occupation. <br /> There shall be no display, no stock-in-trade nor <br /> commodity sold in the dwelling in connection with <br /> the occupation. There shall be no personal physical <br /> service performed in the dwelling, except that a <br /> beauty/barber shop may be operated as a home <br /> occupation, provided that the operation conforms <br /> with the above standards, that no more than one <br /> customer may be provided services at the same time, <br /> and that the operator obtain and maintain in effect <br /> all required permits and licenses. <br /> <br /> 2.
