R-97-32 <br /> <br />A RESOLUTION AUTHORIZING THE CITY ATTORNEY, OR HIS DESIGNEE, TO <br />ACQUIRE BY EMINENT DOMAIN PROCEEDINGS PROPERTY OWNED BY JAMES <br />L. CANADY AND MATTIE LEE CANADY, THEIR HEIRS AND DEVISEES <br />AND/OR PARTIES UNKNOWN, SAID PROPERTY BEING NECESSARY TO <br />PROMOTE THE HEALTH, SAFETY AND WELFARE OF THE CITY AND ITS <br />INHABITANTS. <br /> <br /> WHEREAS, the Council of the City of Portsmouth, Virginia <br />has determined that it is in the public interest to redevelop <br />the area of the Old Riddick-Weaver School, and <br /> <br /> WHEREAS, the City has not been able to acquire the <br />property described herein, which property is necessary to the <br />project, because the owners of said property cannot be found so <br />as to acquire said property by other means, and <br /> <br /> WHEREAS, the advancement of the work and use of the <br />property cannot proceed until it has been acquired, and the use <br />of the property will be unreasonably delayed if the property is <br />not made available as soon as possible. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> That the City Attorney be, and he hereby is, directed to <br />institute eminent domain proceeding, or cause such proceedings <br />to be instituted against the hereinafter described property <br />situate in the City of Portsmouth, Virginia, for the purpose of <br />acquiring fee simple title thereto pursuant to Sections 2.06, <br />2.07 and 2.08 of the Charter of the City of Portsmouth, <br />Virginia, as amended, said property being Lot 31 as shown on <br />the plat known and designated as "Plan of Tabb's Land", which <br />said plat is duly recorded in the Clerk's Office of the Circuit <br />Court of the City of Chesapeake in Deed Book 81, at page 470. <br /> <br /> The names of the property owners are James L. Canady and <br />Mattie Lee Canady, their heirs and devisees and/or parties <br />unknown. <br /> <br /> The property has been appraised for $3,400.00. and such <br />sum as the Court shall order as compensation shall be paid <br />according to order of said Court. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held June 24, 1997. <br /> <br /> Teste: <br /> <br /> <br /> City Clerk <br /> <br /> <br />
