That this use permit is approved subject to the <br />following conditions: <br /> <br /> (a) Occupancy of the second floor shall be limited to <br /> 96 patrons. <br /> <br /> (b) The second floor of the facility shall be <br /> generally configured as shown on Exhibit A, <br /> attached hereto and made a part hereof. <br /> <br /> (c) The facility's hours of operation shall be <br /> limited to between 10:00 a.m. and 2:00 a.m. <br /> <br /> (d) The occupancy of the entire building shall not <br /> exceed one hundred patrons after 11:00 p.m. <br /> <br /> (e) The rear door on the second floor shall be used <br /> as an emergency exit only and may not be propped <br /> open during the hours of operation. <br /> <br /> (f) The dumpster must be screened with vegetation or <br /> an opaque fence approved by the Downtown Design <br /> Committee. <br /> <br /> (g) The applicant must provide a total of 24 <br /> off-street parking spaces for the proposed use. <br /> A parking agreement for any off-site parking must <br /> be approved by the City Attorney's Office. <br /> <br /> (h) The applicants shall comply with all applicable <br /> codes, ordinances and regulations of federal, <br /> state and local governments, and shall obtain and <br /> maintain in effect all necessary licenses and <br /> permits. <br /> <br /> (i) Entertainment is allowed as an accessory to the <br /> use only and may not be the primary function of <br /> the facility. Entertainment shall be limited to <br /> recorded music or live performances by small <br /> groups not more than three days per week.
