<br /> UP-96-21 <br /> Beginning at the northwest corner of the <br /> intersection of Elm Avenue and Hoover Street; <br /> thence, west 105'± to a point; thence, south <br /> 50.5'+/- to a point; thence, east 105'± to a <br /> point; thence, north 50.5'± to the point of <br /> the beginning. <br /> <br />3. That this use permit is approved subject to the following <br />conditions <br /> <br /> (a) The capacity of the day care center shall be <br /> limited to nine (9) children, no more than <br /> five of which shall be under the age of 2 1/2 <br /> years. <br /> <br /> (b) Pick-up and drop-off of children shall be <br /> limited to Hoover Street. <br /> <br /> (c) The applicant shall submit a landscaping plan <br /> for approval by the Planning Department. <br /> <br /> (d) Outdoor activities shall be limited to the <br /> hours between 10 A.M. and 5 P.M. <br /> <br /> (e) Indoor activities shall be limited to the <br /> hours between 6 A.M. and 6 P.M. <br /> <br /> (f) The facility shall be inspected annually by <br /> the Health Department, Fire Department and the <br /> Building Official's Office. <br /> <br /> (g) The applicant shall comply with all applicable <br /> codes, ordinances and regulations of federal, <br /> state and local governments; and, shall obtain <br /> and maintain all necessary licenses and <br /> permits. <br /> <br /> (h) All food preparation facilities must meet all <br /> applicable City Fire and Building Code <br /> requirements. <br /> <br /> (i) The entire rear yard shall be enclosed with <br /> stockade fencing six feet in height along the <br /> side and rear property lines. Fencing facing <br /> the front of the subject property shall be <br /> four feet in height. <br /> <br /> 4. EXPIRATION OF PERMIT: If operation of the facility <br />is not commenced within two years of the date hereof, the use <br />permit shall expire. <br /> <br /> <br />
