AN ORDINANCE CLOSING AND VACATING A PORTION OF <br />COLUMBIA STREET. <br /> <br /> WHEREAS, Airline Development Company, L.L.C. and Presbyterian <br />League of Presbytery of Eastern Virginia, Inc. have made application to close and <br />vacate a portion of Columbia Street as hereafter described; and <br /> <br /> WHEREAS, the Planning Commission, at a meeting held on June 2,1998, <br />recommended approval of the closing and vacating of said portion of said street; <br />and <br /> <br /> WHEREAS, notice of the proposed closure has given adjoining property <br />owners in accordance with Section 15.2-2006 of the Code of Virginia, 1950, as <br />amended. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City of <br />Portsmouth, Virginia that the portion of said street be closed and vacated as a <br />public street, as follows: <br /> <br /> All that certain portion of Columbia Street located in the City of <br /> Portsmouth, Virginia, described as follows: Beginning at an iron <br /> rod at the southeast corner of the intersection of Loudon Avenue <br /> and Columbia Street, thence continuing along the southern margin <br /> of Columbia Street S. 89 59' 13" E. 120 feet to an iron rod being the <br /> POINT AND PLACE OF BEGINNING; thence continuing along <br /> said southern margin of Columbia Street S. 89 59' 13" E. 60;00 feet; <br /> thence N, 00 00' 47" E. 50.18 to a nail in the northern margin of <br /> Columbia Street; thence along the northern margin of Columbia <br /> Street N. 89 59' 13" W. 60.00 feet; thence S .00 00' 47" W. 5018 feet <br /> to an iron rod being the said point of beginning, be closed and <br /> vacated as a public right-of-way and street. <br /> <br /> BE IT FURTHER ORDAINED that a perpetual easement is hereby <br />reserved unto the City of Portsmouth in the area of Columbia Street hereby <br />closed and vacated for the installation, operation, maintainance and replacement <br />of public utilities, which said easement may be closed and vacated by the City <br />Manager as he may in his discretion deem appropriate, and in the best interest of <br />the City of Portsmouth. <br /> <br /> <br />
