AN ORDINANCE TO AMEND CHAPTERS 16, 23, AND 35 OF THE CODE OF <br />THE CITY OF PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTIONS <br />16-69(b), 23-7, 35-3(e), 35-5(a), AND 35-74 AND BY REPEALING SECTIONS 35- <br />31 THROUGH 35-39 THEREOF PERTAINING TO THE POSITION OF <br />DELINQUENT TAX COLLECTOR. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Sections 16-69(b), 23-7, 35-3(e), 35-5(a), and 35-74 ofthe Code of <br />the City of Portsmouth, Virginia (1988) be amended and reordained to read as follows: <br /> <br />Sec. 16-69. Payment of bills; delinquent charges; discontinuance of service. <br /> <br /> (b) The director shall discontinue collecting refuse from a delinquent operator, <br />owner or tenant after giving fifteen (15) days' written notice thereof. A copy of the notice <br />shall be delivered to the city attorney, the health department, the city treasurer and the <br />director of public utilities. The city treasurer shall include the delinquent charges with <br />other taxes or fees to be collected from the operator, owner or tenant, and the director of <br />public utilities may, in addition, discontinue water and sewer service to the delinquent <br />operator, owner or tenant. <br /> <br />Sec. 23-7. Annual report of money collected in connection with abatement by <br />city. <br /> <br /> The treasurer shall annually report to the city manager the amount of money <br />collected in connection with the abatement of nuisances by the city. <br /> <br />Sec. 35-3. Same--Taxes an personal property and machinery and tools. <br /> <br /> (e) In the instance that the city treasurer collects any tax owed to the city as a <br />consequence of an action by an agency of the Commonwealth of Virginia pursuant to any <br />program authorized by the Code of Virginia, any fee(s) that such agency is allowed to <br />charge the city or the taxpayer, pursuant to the Code of Virginia for the agency's <br />participation in such program may be billed and collected from the taxpayer by the city <br />treasurer. <br /> <br /> <br />
