AN ORDINANCE CLOSING AND VACATING A PORTION OF FAYETTE STREET <br />AND FIFTH STREET. <br /> <br /> WHEREAS, Portsmouth Redevelopment and Housing Authority has made application to <br />close and vacate a portion of Fayette Street and a portion of Fifth Street; and <br /> <br /> WHEREAS, the Planning Commission of the City of Portsmouth, Virginia, at a meeting <br />held on April 7, 1998, recommended approval of the closing and vacating of said streets, or <br />portions thereof; and <br /> <br /> WHEREAS, notice of the proposed closure and vacation has been given adjoining <br />property owners in accordance with Section 15.2-2006 of the Code of Virginia, 1950, as <br />amended. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia that the hereinafter described be closed and vacated as public streets. <br /> <br /> FAYETTE STREET <br /> <br /> All that portion of Fayette Street as shown on that certain plat entitled," Subdivision of <br />Portcentre Commerce Park, Portsmouth, Virginia", which said plat is duly recorded in the <br />Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia in Map Book 13, at pages <br />253 through 256, from its intersection with the western right of way line of Portcentre Parkway a <br />to its intersection with the eastern right of way line of Sixth Street. <br /> <br /> FIFTH STREET <br /> <br /> All that portion of Fifth Street as shown on that certain plat entitled," Subdivision of <br />Portcentre Commerce Park, Portsmouth, Virginia", which said plat is duly recorded in the <br />Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia in Map Book 13, at <br />pages 253 through 256, from its intersection with the southern right of way line of Nelson Street <br />to its intersection with the northern right of way line of Jefferson Street. <br /> <br /> BE IT FURTHER ORDAINED by the Council of the City of Portsmouth, Virginia, <br />that there is hereby reserved to the City of Portsmouth easements over, under and across the <br />streets, or portions of streets, hereby closed and vacated by this ordinance for installation, <br />maintenance, construction and removal of public utilities. <br /> <br /> <br />
