2. That Section 40-22 of the Code of the City of
<br />Portsmouth, Virginia (1988) be amended by deleting the
<br />definition "Nightclub."

<br /> 3. That Table 40-43.1-2 of the Code of the City of
<br />Portsmouth, Virginia (1988) be amended by deleting the Uses
<br />"Eating and Drinking Places," "Caterer," "Eating Place
<br />(Drive-In)," "Place (Incidental)," "Drinking Place," "Drinking
<br />Place (Incidental)," " and "Nightclub"; by adding the new Use
<br />"Eating Establishment (ENB)" (SiI.C. 58) as a permitted use in
<br />the Planned Office Park POP, Commercial C-1, Commercial C-2,
<br />Waterfront W-1, Commerce Park CP, and Industrial M-1 zoning
<br />districts, and as a use requiring a use permit in the
<br />Industrial M-1-R zoning district, all subject to Parking Group
<br />8 requirements; by adding the new Use "Restauarant" as a use
<br />requiring a use permit in the Planned Office Park POP,
<br />Commereiat C-1, Commercial C-2, Waterfront W-1, Commerce Park
<br />CP, Industrial M-1 and Industrial M-1-R zoning districts,
<br />subject to Parking Group 8 requirements; and by adding the new
<br />Use "Entertainment Establishment" as a use requiring a use
<br />permit in the Commercial C-2 and Industrial M-1 zoning
<br />districts, subject to Parking Group 40 requirements, as shown
<br />on Exhibit A, attached hereto and made a part hereof.

<br /> Portsmouth, Virginia (1988) be amended by deleting the uses
<br /> "Eating and Drinking Places," "Caterer," "Eating Place
<br /> (Drive-In)," "Eating Place (Incidental)," "Drinking
<br /> Place," "Drinking Place (Incidental)," and "Nightclub"; by
<br /> adding the new Use "Eating Establishment (ENB)" (S.I.C. 58) as
<br /> a permitted use in the Downtown D-1-O and D-2-O Office
<br /> subdistricts, Downtown D-1-CB and D-2-CB Central Business
<br /> subdistricts, Downtown D-1-C and D-2-C Commercial subdistricts,
<br /> and the Downtown D-1-M and D-2-M Mixed Use subdistricts, and as
<br /> a use requiring a use permit in the Downtown D-1-TCA and
<br /> D-2-TCA Trade, Cultural and Arts subdistricts, all subject to
<br /> Condition 66 and Parking Group 8 requirements; by adding the
<br /> new Use "Restaurant" as a use requiring a use permit in the
<br /> Downtown D-1-O and D-2-O Office subdistricts, Downtown D-1-CB
<br /> and D-2-CB Central Business subdistricts, Downtown D-1-C and
<br />
<br />· D-2-C Commercial subdistricts, the Downtown D-1-M and D-2-M
<br /> Mixed Use subdistricts, and the Downtown D-1-TCA and D-2-TCA
<br /> Trade, Commerce and Arts subdistricts, all subject to Parking
<br /> Group 8 requirements; and by adding the new Use "Entertainment
<br /> Establishment" requiring a use permit in the Downtown D-1-CB
<br /> and D-2-CB Central Business subdistricts, Downtown D-1-C and
<br /> D-2-C Commercial subdistricts, the Downtown D-1-M and D-2-M
<br /> Mixed Use subdistricts, and the Downtown D-1-I and D-2-I
<br /> Industrial subdistricts, all subject to Parking Group 40
<br /> requirements, as shown on Exhibit B, attached hereto and made a
<br /> part hereof.
