UP-98-01 <br /> <br />Beginning at the southwestern corner of Broad Street and Cleveland <br />Street; thence, southeast along the western right-of-way line of Broad <br />Street 120 feet; thence, southwest 140 feet to an alley; thence northwest <br />along said alley 120 feet to the southern right-of-way of Cleveland Street; <br />thence, northeast along said right-of-way 140 feet to the point of <br />beginning. The property is also known as Lots 681,682 & 683, Map of <br />Port Norfolk Land Company. <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br />(a) Unless otherwise provided herein, the inn shall be operated in <br />accordance with a letter dated January 6, 1998, from Jill Cave to the <br />Planning Commission, identified as Exhibit A and made a part hereof. <br /> <br />(b) No more than three bedrooms shall be used for the inn. <br /> <br />(c) The applicants shall keep a guest register of all guests and shall make <br />the register available for inspection to the City of Portsmouth at any time. <br /> <br />(d) Only overnight guests may be served meals or refreshments. <br />Commercial meal service may not be offered to non-overnight inn guests. <br /> <br />(e) No additions, exterior alterations or signage may be constructed or <br />installed unless approved by the Commission of Architectural Review. <br /> <br />(f) The applicants shall provide at least four off-street parking spaces. The <br />spaces shall be available for use by any guests. <br /> <br />(g) Prior to commencement of operation, the applicants shall obtain a <br />commercial re-inspection of the facility. <br /> <br />(h) The applicants shall operate the inn in accordance with Section 40- <br />52.7 of the Zoning Ordinance and all applicable codes, ordinances and <br />regulations of federal, state and local governments, and shall obtain and <br />maintain in effect all necessary licenses and permits. All taxes owed on or <br />in connection with the property shall be paid in a timely fashion in <br />accordance with deadlines established by law. <br /> <br />(i) The use permit is issued to Mark and Jill Cave and is not transferable. <br /> <br /> <br />
