UP-9841 <br /> <br /> Beginning at the southwest corner of the intersection of Highland Avenue <br /> and Lansing Avenue; thence south 108'+ to a point; thence, west 75'+ to a <br /> point, thence, north 108' to a point; thence, east 75'+ to the point of the <br /> beginning. <br /> <br /> 3. That this use permit is approved subject to the following conditions: <br /> <br /> (a) Occupancy of the facility shall be limited to twelve children. <br /> <br />(b) No more than five children under the age of 30 months shall be present in the facility <br />at any time. <br /> <br />(c) Outdoor activities shall be limited to between the hours of 10:00 A.M. and 6:00 P.M. <br />Indoor hours of operation shall be limited to between 6:00A. M. and 6:00 P.M. <br /> <br />(d) The facility shall submit to ali required inspections by the Fire Department, the <br />Public Health Department and the Building Official and shall correct any noted <br />deficiencies. <br /> <br />(e) The project shall be developed in accordance with the submitted floor plan, <br />identified as Exhibit A, a copy of which is attached hereto and made a part hereof. <br /> <br />(f) Drop-off and pick-up of children shall only be from the dead-end of Highland <br />Avenue. <br /> <br />(g) The facility shall comply with all applicable federal, state, and local codes, <br />ordinances and regulations of federal, state and local governments, and shah obtain and <br />shall maintain in effect all necessary licenses and permits. <br /> <br />(h) All taxes and fees shall be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, at meeting held on <br />September 22, 1998. <br /> <br /> Teste: <br /> <br /> <br /> City Clerk <br /> <br /> <br />
