ZONING AMENDMENT ORDINANCE Z-99-05 BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That the portion of the zoning map attached to and made a part of the City of Portsmouth Zoning Ordinance which now zones as Residential RM-60, the property described in Petition for Zoning Amendment Number Z-99-05, is hereby amended and changed so as to show said property zoned as Industrial M-1-K (Conditional), and that said property is hereby zoned as Industrial M-1-K (Conditional). 2. That the property affected by this ordinance by being zoned from Residential RM-60 to Industrial M-1-K (Conditional) is described as follows: Z-99-05 Beginning at the southwest right-of-way of Bayview Boulevard and Chautauqua Avenue; thence, in a southerly direction 56'+ to a point of the beginning; thence, in a southerly direction 265'+ to a point; thence, in an easterly direction 152'+ to a point; thence, thence, in a northerly direction 260'+ to a point; thence, in a westerly direction 152'+ to a point of the beginning. 3. That the following conditions, proffered by the applicant, shall apply to the subject property: (a) A twenty-foot wide landscaping screening buffer shall be retained along the subject site's entire road frontage parallel to Chatauqua Avenue, excluding the site's existing access to Chatauqua Avenue. All existing trees and shrubs shall be maintained within the buffer. (b) The only uses that may occur on the property subject to this rezomng are as follows: (1) Truck/automobile maimenance and service facilies (2) Office/employee restrooms (3) Employee parking facility (4) Any required stormwater management facilities (c) No bay doors associated with the development and operation of the truck/maintenance and service facility shall face Chautauqua Avenue. 4. That this ordinance shall take effect on the date of its adoption.
