ZONING AMENDMENT ORDINANCE Z-99-05 <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That the portion of the zoning map attached to and made a part of the City <br />of Portsmouth Zoning Ordinance which now zones as Residential RM-60, the property <br />described in Petition for Zoning Amendment Number Z-99-05, is hereby amended and <br />changed so as to show said property zoned as Industrial M-1-K (Conditional), and that <br />said property is hereby zoned as Industrial M-1-K (Conditional). <br /> <br /> 2. That the property affected by this ordinance by being zoned from <br />Residential RM-60 to Industrial M-1-K (Conditional) is described as follows: <br /> <br /> Z-99-05 <br /> <br /> Beginning at the southwest right-of-way of Bayview <br /> Boulevard and Chautauqua Avenue; thence, in a southerly <br /> direction 56'+ to a point of the beginning; thence, in a <br /> southerly direction 265'+ to a point; thence, in an easterly <br /> direction 152'+ to a point; thence, thence, in a northerly <br /> direction 260'+ to a point; thence, in a westerly direction <br /> 152'+ to a point of the beginning. <br /> <br /> 3. That the following conditions, proffered by the applicant, shall apply to <br />the subject property: <br /> <br /> (a) A twenty-foot wide landscaping screening buffer shall be retained along <br /> the subject site's entire road frontage parallel to Chatauqua Avenue, <br /> excluding the site's existing access to Chatauqua Avenue. All existing <br /> trees and shrubs shall be maintained within the buffer. <br /> <br /> (b) The only uses that may occur on the property subject to this rezomng are <br /> as follows: <br /> (1) Truck/automobile maimenance and service facilies <br /> (2) Office/employee restrooms <br /> (3) Employee parking facility <br /> (4) Any required stormwater management facilities <br /> <br /> (c) No bay doors associated with the development and operation of the <br /> truck/maintenance and service facility shall face Chautauqua Avenue. <br /> <br /> 4. That this ordinance shall take effect on the date of its adoption. <br /> <br /> <br />
