1999-5 <br /> <br /> ZONING AMENDMENT ORDINANCE Z-98-05 <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That the portion of the zoning map attached to and made a part of the City <br />of Portsmouth Zoning Ordinance wHich now zones as Historic Residential HR, the <br />property described in Petition for Zoning Amendment Number Z-98-05, is hereby <br />amended and changed so as to show said property zoned as Waterfront W-1-K <br />(Conditional), and that said property is hereby zoned as Waterfront W-1-K (Conditional). <br /> <br /> 2. That the property affected by this ordinance by being zoned from Historic <br />Residential HR to Waterfront W-1-K (Conditional), is described as follows: <br /> <br /> Z-98-05 <br /> <br /> Beginning at the northwest intersection of Harrell <br /> Street and Webster Avenue at a point; thence, north <br /> 142'+/- to a point; thence, west 270'+/- to a point; thence, <br /> south 142'+/- to a point; thence, east 270' +/- to the point <br /> of beginning. <br /> <br /> 3. That the following conditions, proffered by the applicants, shall apply to the <br />subject property: <br /> <br /> (a) The uses of the site are limited to a marina, crab house, and <br /> retail operation. <br /> <br /> (b) The layout of the site shall conform to the Preliminary Site <br /> Plan dated January 20, 1999, except as necessary to comply with <br /> (c) below. <br /> <br /> (c) Prior to the issuance of any building permits, the site plan may be <br /> revised as necessitated to comply with the Chesapeake Bay Ordinance <br /> exception granted by the Portsmouth Planning Commission and/or <br /> the Joint Permit Application process involving the United States <br /> Army Corps of Engineers, Virginia Marine Resources Commission, <br /> Virginia Department of Environmental Quality, and the Portsmouth <br /> Wetlands Board, where applicable. <br /> <br /> (d) To the extent that an action by any governmental agency is more <br /> <br /> <br />
