AN ORDINANCE CLOSING AND VACATING A PORTION OF BART STREET BOUNDED BY THE CRAWFORD CONNECTOR {CONNECTOR "S") ON THE WEST TO ITS POINT OF TERMINATION IN THE SOUTHERN BRANCH OF THE, ELIZABETH RIVER, AND CLOSING AND VACATING A PORTION OF CRAWORD STREET BOUNDED ON THE NORTH BY THE RIGHT OF WAY OF THE CRAWFORD CONNECTOR (CONNECTOR "S") AND ON THE SOUTH BY THE CHANNEL OF GANDER CREEK. WHEREAS, the City of Portsmouth and the Commonwealth of Virginia (Virginia Department of Transportation) have made application to close a portion of Bart Street bounded on the west by the Crawford Connector (Connector "S") to its point of termination in the southern branch of the Elizabeth River; and a portion of Crawford Street bounded on the north by the Crawford Connector (Connector "S") and on the south by the channel of Gander Creek: and WHEREAS, the Planning Commission of the City of Portsmouth, at a meeting held on October 5, 1999, recommended approval of the closing and vacating of said streets; and WHEREAS, notice if closure has been given adjoining property owners in accordance with Section 15.2-2006 of the Code of Virginia, 19540, as amended. NOW, THEREFORE, BE IT ORDAINED by the CoUncil of the City of Portsmouth, Virginia that a portion of Bart Street and a portion of Crawford Street be closed and vacated as a public streets and right of ways, as follows, to-wit: All that certain portion of Bart Street located and being in the City of portsmouth, Virginia, said portion being bounded on the west by the Crawford Connector (Connector "S") to its Point of termination in the southern branch of the Elizabeth River, And All that portion of Crawford Street located and being in the City of Portsmouth, Virginia bounded on the north by the Crawford Connector (Connector "S") and on the south by the Channel of Gander Creek BE IT FURTHER ORDAINED that the City of Portsmouth hereby reserves an easement in those portions of Bart Street and Crawford Street hereby closed and vacated for the installation, operation, maintenance and replacement of public utilities of the City of Portsmouth and private utilities, which said easement may be released and vacated by the Manager of the City of Portsmouth as he may in his discretion deem appropriate and in the best interest of the City of Portsmouth.
