AN ORDINANCE TO AMEND CHAPTER 40 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 40-22 AND TABLES 40-43,1-1, 40-43.1-2, AND 40-43.1-3 THEREOF PERTAINING TO CHILD CARE CENTERS. BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That Section 40-22 of the Code of the City of Portsmouth, Virginia (1988) be amended and reordained to delete the definition ChildDay Care Services and to add the following definitions of Family Day Care Home, Child Care Center, and Religious Facility Based Child Care Center to read as follows: Child Care Center. Any facility providing day care on a regular basis for compensation for two or more children under the age of 13 years in a nonresidential location, including such facilities required to be licensed by the Virginia Department of Social Services. Family Day Care Home. Any residential facility providing day care on a regular basis for compensation for between six and twelve children under the age of 13 years at the same time, including such facilities required to be licensed by the Virginia Department of Social Services. Religious Facility Based Child Care Center. Any religious facility, providing space on a regular daily basis for compensation for day care for six or more children, where the space used is part of a larger facility used for other religious purposes. The child care center may be operated by the religious body or operated and managed by an outside provider and shall include such facilities required to be licensed by the Virginia Department of Social Services. 2. That Table 40-43.1-I be amended to delete the use "Child Day Care Services" and to permit the uses "Religious Facility Based Child Care Center" and "Family Day Care Home" in all Residential zoning districts, upon approval of a use permit, subject to Condition 70 and Parking Group 40. 3. That Table 40-43.1-2 be amended to delete the use "Child Day Care Services" and to permit the use "Child Care Center" in the OR-75, POP. C-l, C-2, CP and M-1 zoning districts, the use "Religious Facility Based Child Care Center" in the OR-75, C-l, and C-2 zoning districts, and the use "Family Day Care Home" in the OR-75, C-1 and C-2 zoning districts, upon approval of a use permit, all subject to Condition 70 and Parking Group 40. 4. That Table 40-43.1-3 be amended to delete the use "Child Day Care Services" and to permit the uses "Child Care Center." "Religious Facility Based Child Care Center" and "Family Day Care Home" in all Downtown D-1 and D-2 zoning subdistricts, upon approval of a use permit, subject to Condition 70 and Parking Group 40.
