UP-96-06 <br /> <br /> Beginning at a point approximately <br />210 feet from the northwestern <br />intersection of North Street and Middle <br />Street thence west 115.5 feet to a point; <br />thence north approximately 85 feet to a <br />point; thence east approximately 150 feet <br />to a point; thence south 79.1 feet to a <br />point; thence west approximately 28 to a <br />point; thence south approximately 5 feet <br />along the southwestern right-of-way line <br />of Middle Street to the point of <br />beginning. <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br />(a) The applicants shall convert the non-residential structure into a two-family <br /> dwelling in accordance with the floor and elevation plans, identified as <br /> Exhibits A and B, attached hereto and made a part hereof. The Director of <br /> Community Quality and Planning Services may approve minor modifications <br /> to the plans. <br /> <br />(b) All exterior renovations must be approved by the Commission of Architectural <br /> Review prior to construction. <br /> <br />(c) The applicants shall obtain a waiver from the Board of Zoning Appeals prior <br /> to the issuance of the building permm <br /> <br />(d) The applicants shall be responsible for the cost of public utility upgrades <br /> required for the project. <br /> <br />(e) All taxes owed on the subject property shall be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, at a meeting held on April <br />27, 1999. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
