UP-96-12 Beginning on the south right-of-way of Elliott Avenue 135' + west from its intersection with the west right-of-way of Deep Creek Boulevard; thence southeasterly 222.59' to a point; thence, west 97.55' + to a point; thence, northwesterly 196.52 +to the south right-of-way of Elliott Avenue; thence, northeasterly along said right-of-way to the point of the beginning. 3. That this amended use permit is approved subject to the following conditions: (a) Occupancy of the facility shall be limited to no more ninety-eight children. (b) The facility shall comply with the submitted site plan, floor plan, and building elevation identified respectively as Exhibits A,B, and C, attached hereto and made a part hereof. (c) Indoor operations shall be limited to the hours between 6:00 A.M. and 6:00 P.M., Monday through Friday. Outdoor play hours shall be limited to the hours between 10:00 A.M. and 6:00 P.M. (d) No less than 9,800 square feet shall be provided for the outdoor play area, and the area shall be enclosed with a fence at least four feet in height. (e) The applicant shall maintain nineteen paved, on-site parking spaces. (f) The proposed modular unit shall be equipped with fire extinguishers and pull stations as required by the Fire Department. (e) The facility shall submit to all required inspections by the Fire Department and the Building Official and shall correct any noted deficiencies. (f) The facility shall comply with all applicable federal, state, and local codes, ordinances and regulations and shall obtain and shall maintain in effect all necessary licenses and permits. (g) All taxes and fees on the subject property and the operation shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council.
