UP-96-12 <br /> <br />Beginning on the south right-of-way of Elliott Avenue 135' <br />+ west from its intersection with the west right-of-way of <br />Deep Creek Boulevard; thence southeasterly 222.59' to a <br />point; thence, west 97.55' + to a point; thence, <br />northwesterly 196.52 +to the south right-of-way of Elliott <br />Avenue; thence, northeasterly along said right-of-way to <br />the point of the beginning. <br /> <br />3. That this amended use permit is approved subject to the following conditions: <br /> <br />(a) Occupancy of the facility shall be limited to no more ninety-eight <br />children. <br /> <br />(b) The facility shall comply with the submitted site plan, floor plan, and <br />building elevation identified respectively as Exhibits A,B, and C, attached <br />hereto and made a part hereof. <br /> <br />(c) Indoor operations shall be limited to the hours between 6:00 A.M. and <br />6:00 P.M., Monday through Friday. Outdoor play hours shall be limited to <br />the hours between 10:00 A.M. and 6:00 P.M. <br /> <br />(d) No less than 9,800 square feet shall be provided for the outdoor play area, <br />and the area shall be enclosed with a fence at least four feet in height. <br /> <br />(e) The applicant shall maintain nineteen paved, on-site parking spaces. <br /> <br />(f) The proposed modular unit shall be equipped with fire extinguishers and <br />pull stations as required by the Fire Department. <br /> <br />(e) The facility shall submit to all required inspections by the Fire Department <br />and the Building Official and shall correct any noted deficiencies. <br /> <br />(f) The facility shall comply with all applicable federal, state, and local <br />codes, ordinances and regulations and shall obtain and shall maintain in <br />effect all necessary licenses and permits. <br /> <br />(g) All taxes and fees on the subject property and the operation shall be paid <br />when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council. <br /> <br /> <br />
