UP-99-14 <br /> <br /> Beginning at a point 140'+ north of the intersection <br />of Greenwood Drive and Cavalier Boulevard; thence, in a <br />southerly direction 185.10'+ to a point; thence, in a <br />westerly direction 150'+ to a point; thence, in a northerly <br />direction 185.15'+ to a point; thence, in an easterly <br />direction 152.58'+ to a point of the beginning. <br /> <br />3. This Use Permit is approved subject to the following conditions: <br /> <br />(a) The occupancy of the daycare facility shall be limited to no more than one <br />hundred fifty (150) children. <br /> <br />(b) The age range of the children shall be from newborn to twelve (12) years <br />of age. <br /> <br />(c) Indoor hours of operation shall be limited to the hours between 6:00 a.m. <br />to 6:00 p.m. Monday through Friday. Outdoor play hours shall be limited <br />to the hours between 8:00 a.m. to 6:00 p.m. <br /> <br />(d) The outdoor play area shall be enclosed with a fence at least four (4) feet <br />in height. No more than sixty-one (61) children may occupy the play area <br />at one time. <br /> <br />(e) The applicant shall maintain twenty-three (23) off street parking spaces for <br />the facility. <br /> <br />(f) The facility shall comply with the submitted floor plan (Exhibit A), <br />building elevations (Exhibit B) and site plan (Exhibit C). <br /> <br />(g) The parking lot must be landscaped in accordance with a Landscaping <br />Plan approved by the Division of Planning and Zoning of the Department <br />of Community Quality and Planning Services. <br /> <br />(h) The facility shall submit to all required inspections by the City's Fire <br />Prevention Bureau, Public Health Department and Building Official. <br /> <br />(i) The applicant shall comply with all applicable codes, ordinances, and <br />regulations of federal, state and local governments and shall obtain and <br />maintain all necessary licenses and permits. <br /> <br />(j) All taxes and fees shall be paid in a timely manner. <br /> <br /> <br />
