UP-99-14 Beginning at a point 140'+ north of the intersection of Greenwood Drive and Cavalier Boulevard; thence, in a southerly direction 185.10'+ to a point; thence, in a westerly direction 150'+ to a point; thence, in a northerly direction 185.15'+ to a point; thence, in an easterly direction 152.58'+ to a point of the beginning. 3. This Use Permit is approved subject to the following conditions: (a) The occupancy of the daycare facility shall be limited to no more than one hundred fifty (150) children. (b) The age range of the children shall be from newborn to twelve (12) years of age. (c) Indoor hours of operation shall be limited to the hours between 6:00 a.m. to 6:00 p.m. Monday through Friday. Outdoor play hours shall be limited to the hours between 8:00 a.m. to 6:00 p.m. (d) The outdoor play area shall be enclosed with a fence at least four (4) feet in height. No more than sixty-one (61) children may occupy the play area at one time. (e) The applicant shall maintain twenty-three (23) off street parking spaces for the facility. (f) The facility shall comply with the submitted floor plan (Exhibit A), building elevations (Exhibit B) and site plan (Exhibit C). (g) The parking lot must be landscaped in accordance with a Landscaping Plan approved by the Division of Planning and Zoning of the Department of Community Quality and Planning Services. (h) The facility shall submit to all required inspections by the City's Fire Prevention Bureau, Public Health Department and Building Official. (i) The applicant shall comply with all applicable codes, ordinances, and regulations of federal, state and local governments and shall obtain and maintain all necessary licenses and permits. (j) All taxes and fees shall be paid in a timely manner.
