R-99-50 <br /> <br />A RESOLUTION APPROVING THE MAJOR DESIGN FEATURES OF THE <br />PROPOSED BART STREET IMPROVEMENTS. <br /> <br /> WHEREAS, a Notice of Willingness to Hold a Public Hearing was posted for <br />the purpose of considering the design features for Project No. 0017-124-108, PE-101 for <br />a portion of Bart Street in the City of Portsmouth; and <br /> <br /> WHEREAS, no requests were received or inquiries were satisfactorily answered. <br />so that a public hearing is not required; and <br /> <br /> WHEREAS, the City Council has previously requested the Virginia Department <br />of Transportation ("the Department") to program this project. <br /> <br /> NOW THEREFORE BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia that it hereby approves the major design features of the proposed <br />project as presently designed. <br /> <br /> BE IT FURTHER RESOLVED that the City &Portsmouth will acquire all <br />rights of way necessary for this project and certify same to the Department at the <br />appropriate time. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager is hereby authorized to <br />execute, on behalf of the City of Portsmouth, all railroad and utility agreements required <br />in conjunction with the acquisition of such rights of way. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, at a meeting held on <br />September 14, 1999. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
