3. That this use permit is approved subject to the following conditions: <br /> <br />(a) The seating capacity of the restaurant shall be limited to no more than 72 seats. <br /> <br />(b) The hours of operation of the restaurant shall be limited to the hours of 11:00 a.m. to <br />10:00 p.m. daily. <br /> <br />(c) All exterior renovations and signage must be approved by the Downtown Design <br />Committee prior to construction. .. <br /> <br />(d) The apartment conversions on the second and third floors shall be in accordance with <br />the submitted floor plans identified as Exhibit A, attached hereto and made a part hereof. <br />The Director of Community Quality and Planning Services may approve minor <br />modifications to the floor plans. <br /> <br />(e) The applicant shall obtain a parking exception from the city prior to obtaining any <br />occupancy permit. <br /> <br />(f) The structure shall be inspected annually as required by the City Fire Prevention <br />Bureau, Public Health Department and Building Official, and the applicant shall <br />promptly correct such deficiencies as may be noted. <br /> <br />(g) The applicant shall obtain a commercial re-inspection for the facility by the City's <br />Fire Prevention Bureau, Public Health Department and Building Official. <br /> <br />(h) The applicant shall be responsible for the all costs of upgrading utilities for the <br />project. <br /> <br />(i) The applicant shall comply with all applicable codes, ordinances, and regulations of <br />federal, state, and local governments and shall obtain and maintain in effect all necessary <br />licenses and permits. <br /> <br />(j) All real estate taxes, personal property taxes, and business license taxes owed on or in <br />connection with the property and any operations thereon shall be paid when due. <br /> <br /> REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, at a meeting held on <br />August 24, 1999. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
