AN ORDINANCE TO AMEND CHAPTER 33 OF THE CODE OF THE CITY OF <br />PORTSMOUTH, VIRGINIA (1988) BY AMENDING SECTION 33-2 THEREOF <br />PERTAINING TO THE DEFINITION OF A SUBDIVISION. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That the definition of "Subdivision" contained in Section 33-2 of the Code <br />of the City of Portsmouth, Virginia (1988) be amended and reordained to read as follows: <br /> <br />Sec. 33-2. Definitions. <br /> <br /> Subdivision. The division of a parcel of tand into two or more lots or parcels of <br />less than five acres each for the purpose of transfer of ownership or building <br />development, or, if a new street is involved in such a division, any division of a parcel of <br />land. Any subdivision to which the city or the Commonwealth of Virgmia is a parry shall <br />not be deemed a subdivision. <br /> <br /> A subdivision initially not less than ten acres in size and proposed for use for <br />retail sales and related commercial activities may be exempted from the subdivision <br />review requirements of this chapter if a site development plan and any amendment <br />thereto have been previously approved in accordance with the provisions of sections 40- <br />I72 and 40-172.1. The proposed subdivision shall include satisfactory easement <br />agreements that shall be recorded to ensure access to all development parcels resulting <br />from the subdivision. An exemption shall not be granted if a new public street or an <br />extension of an existing public street is involved in the subdivision. The Director of <br />Community Quality and Planning Services, upon the concurrence of the City Manager or <br />his designee, may approve the proposed subdivision and associated development details <br />if he determines that the proposed subdivision meets the subdivision ordinance purpose <br />and standards set forth in Sections 33-3 and 33-11 through 33-14. In his sole discretion, <br />the Director may refer the question of exemption to the Planning Commission for <br />decision. Prior to the recordation of a plat or a subdivision exempted from subdivision <br />review requirements, the director shall certify completion of site development plan <br />review by affixing his signature to such a certification on the plat. Exemption from the <br />subdivision review requirements shall not exempt any such subdivision from the bonding <br />.requirements of this chapter pertaining to the installation and maintenance of public <br />nnprovements. <br /> <br />2.
