2000-6 <br /> <br />AN ORDINANCE CLOSING AND VACATING A PORTION OF WYTHE STREET <br />LYING EAST OF THE, EAST RIGHT OF WAY LINE OF RUTH BROWN AVENUE <br />(FORMERLY SECOND STREET), AND WEST OF THE WEST RIGHT OF WAY <br />LINE OF FIRST STREET. (NOW CLOSED) <br /> <br /> WHEREAS, the City of Portsmouth, the Commonwealth of Virginia (Virginia <br />Department of Transportation), and T.O. Williams, Incorporated have made application to <br />close Wythe Street from its intersection with the west right-of-way line of First Street (now <br />closed) to the east right-of-way line of Ruth Brown Avenue (formerly Second Street); and <br /> <br /> WHEREAS, the Planning Commission of the City of Portsmouth. at a meeting held <br />on March 7, 2000, recommended approval of the closing and vacating of said street; and <br /> <br /> WHEREAS. notice of closure has been given adjoining property owners in accordance <br />with Section 15.2-2006 of the Code of Virginia, 1950, as amended: <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia that a portion of Wythe Street be closed and vacated as a public street and right-of- <br />way, as follows, to-wit: <br /> <br />All that certain portion of Wythe Street located and being in the City of Portsmouth, <br />Virginia, said portion being bounded on the west by the east line of Ruth Brown <br />Avenue (formerly Second Street, and on the east by the west line of First Street (now <br />closed). <br /> <br /> BE IT FURTHER ORDAINED that the City of Portsmouth hereby reserves an <br />easement in that portion of Wythe Street hereby closed and vacated for the installation, <br />operation, maintenance and replacement of public utilities of the City of Portsmouth and <br />private utilities, which said easement may be released and vacated by the Manager of the City <br />of Portsmouth as he may in his discretion deem appropriate and in the best interest of the City <br />of Portsmouth. <br /> <br /> BE IT FURTHER ORDAINED that this closure and vacation shall take effect only <br />upon its recordation in the Clerk's Office of the Circuit of the City of Portsmouth, and that the <br />City Manager shall not record it until such time as the City owns all property adjacent to this <br />street closure, it being the intent of this ordinance that title ro this street not pass m any third <br />party by reason of the closure. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia at a meeting held on March <br />14, 2000. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
