AN ORDINANCE CLOSING AND VACATING PORTIONS OF SOUTH AND FIRST STREETS. WHEREAS, the City of Portsmouth, Virginia has made application to close a portions of South and First Streets, as hereafter described; and WHEREAS, the Planning Commission, at a meeting held on September 5, 2000, recommended approval of the closure and vacation of said portions of South and First Streets; and WHEREAS, notice of the proposed closure and vacation has been given the adjoining property owners in accordance with Section 15.2-2006 of the Code of Virginia, as amended. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia that portions of South and First Streets be closed and vacated as a public streets and rights of way as follows: PORTION OF SOUTH STREET All that certain portion of South Street, being 60 feet in width, located in the City of Portsmouth, Virginia, and lying between the east right of way line of Crawford Street ( now closed ), and the pierhead line on the west side of the Southern Branch of the Elizabeth River. PORTION OF FIRST STREET All that certain portion of First Street, located in rite City of Portsmouth, Virginia, which lies east of the east right of way of that portion of First Street closed by Ordinance Number 1977- 141. The portions of South and First Streets hereby closed and vacated are further shown and designated as the hatched area on Exhibit A, attached hereto, and made a part hereof, entitled: "EXHIBIT SHOWlNG PORTION OF SOUTH STREET AND FIRST STREET TO BE CLOSED AND VACATED, PORTSMOUTH, VIRGINIA', dated August 14, 2000, a copy of which is to be recorded with this Ordinance in the Clerk's Office of the Cimuit Court of the City of Portsmouth, and to which reference may be made for a more exact description of the portions of South and First Streets hereby closed and vacated. BE IT FURTHER ORDAINED that a perpetual easement is hereby reserved unto the City of Portsmouth in that portion of South Street and First Street hereby closed and vacated for the installation, operation, maintenance and replacement of utilities owned and operated by the City of Portsmouth and private utilities, which said easement may be closed and vacated by the City Manager as he may in his discretion deem appropriate, and in the best interest of the City of Portsmouth.
